Police have alleged that a Florida man killed himself while under house arrest, as he awaited trial for sexually abusing his wife’s 14-year-old sister, according to Miami Herald. His 21-year-old wife, Marta San Jose, has also been charged with the rape and is currently in jail.
Dale Leary, 50, was found dead near his South Florida home, in his car, on Tuesday. Authorities have noted, according to Daily Mail, that police found a hose near the vehicle, indicating that he may have died from carbon monoxide poisoning. An autopsy has yet to be performed, however.
Leary had just been released from prison and placed under house arrest after being arrested and charged with sexually abusing his wife’s young sister. Leary and Jose are alleged to have manipulated the 14-year-old into engaging in sexual acts.
The twists and turns keep coming. According to police, Leary and Jose used a brutal form of mental manipulation in order to coerce the 14-year-old into sexual contact. They allegedly told her that she had already been molested by her family, and that they would need to examine her in order to make sure. Then, a criminal complaint has indicated, the couple repeatedly raped the child, telling her that it would help her deal with the non-existent sexual assault at the hands of her parents.
They also lured her into participating in lurid photoshoots by plying her with alcohol, according to court records.
Marta San Jose entered the home of Dale Leary when she was just 16 years old, as a foreign exchange student. They married as soon as she turned 18 and Leary divorced his previous wife, Claudia Leary. According to reports, Jose’s parents had no idea the pair had wed and, thus, allowed the younger sister to also come to Florida as a foreign exchange student.
Leary is an ex-con, having been convicted of sexual assault in the 1980s, according to NY Daily News.
Interestingly, Leary’s ex-wife, Claudia Leary, was also in the car with him, in an alleged attempt at suicide. She was rushed to the hospital and is expected to survive. The pair both left suicide notes, but police have yet to release the content of these notes, as reported by CBS Miami.
“Once our officers responded to the scene, they found two people inside a vehicle,” said Det. Argemis Colome with Miami Dade Police. “Miami-Dade Fire Rescue determined that one male had been deceased on scene and the female was transported to Jackson Hospital.”
Authorities have not announced why they believe Leary’s ex-wife would consent to a double suicide, as she is not a suspect in the rape of the 14-year-old.
Marta San Jose, now 21, however, faces numerous charges, including lewd and lascivious conduct, sexual performance with a child and engaging in a sexual act with a familial child.
