Man found with child porn of missing little girl on his phone; judge gives him 40 years in prison to think about his actions

A Florida man was sentenced on Monday to 40 years in federal prison after investigators found pornographic pictures of a missing girl on his phone.

Jorge Guerrero-Torres, 29, was convicted in May of production and possession of child pornography, News-Press reports.

Guerrero-Torres was staying the home where 9-year-old Diana Alvarez lived when the girl went missing on May 29, 2016.

During sentencing, Federal Judge Sheri Polster Chappell said she wanted it to be clear that she was sentencing the 29-year-old for the pornography charge, but not for the girl’s disappearance.

Guerrero-Torres’ attorney, Roger Azcona, asked the judge for 25 years in prison for his client, who he said “was a responsible worker” that “cooperated in providing a confession that led to the images.”

Chief Assistant United States Attorney, Jesus M. Casas, said that Guerrero-Torres was asked if he had any knowledge of Diana’s whereabouts, but nothing came from that discussion.

During sentencing, Diana’s mother, Rita Hernandez, used her victim impact statement to beg Guerrero-Torres to tell them where her daughter is.

“Please tell me where my daughter is; look me in the face and tell me.”

Thomas Busatta, representing Hernandez, said that though Guerrero-Torres was sentenced only for the pornographic images this time, it wasn’t the end of the line for him.

“This is just the start of it. You still have an active state investigation.”

Hernandez said something similar to Guerrero-Torres during her statement.

“This is not finished; this is not over. For me, this is not over until my daughter is back.”

When it was time for Guerrero-Torres to speak, he gave a very simple apology to the grieving family for what he did to their daughter, which Casas called “conduct most reprehensible for which there is no excuse.”

“I’m sorry. I apologize. That is all.”
