Pregnant mom claims self defense from ‘violent’ boyfriend after she runs him over with SUV, shoots him dead: Police

A Texas woman accused of running her boyfriend over and fatally shooting him claims that she acted in self defense, a state prosecutor said Wednesday during her probable cause hearing.

Houston Chronicle reports that 32-year-old Emily Rose Orbe is facing murder charges in connection with the death of her boyfriend, Davin Walton, 36. According to police, Orbe and Walton were arguing Monday while at the Willowbrook Mall in Houston. At around 8:30 p.m., the couple continued to fight in the parking lot as they left the mall. At this point, Orbe allegedly got into her SUV while Walton got onto his motorcycle. Orbe reportedly gave chase and plowed Walton down.

Witnesses reportedly claimed they heard Walton yelling for help and asking for someone to call police. Prosecutors said Walton was visibly injured after Orbe’s SUV rammed into him, knocking him off of his motorcycle. Orbe then allegedly pulled out a gun and shot Walton in the head and torso.

Orbe reportedly claimed she had no choice but to kill Walton, who she called an abusive boyfriend. Court records indicate he spent around 10 years in prison on a previous conviction.

“I didn’t want to do this, I didn’t want to kill him, I had to though, I had no choice,” Orbe reportedly told a witness. “I was at school, he ripped my clothes, he broke my mirror, he took my phone, he took my wallet, he has my gun, it’s in my name,” Orbe said, according to court documents.

One witness told police that they saw Orbe hit Walton with a silver Dodge SUV, followed by the sound of gunshots, according to KHOU11. The witness said Orbe was standing outside of the SUV, crying hysterically and asking bystanders to call the police.

Another witness told police he saw Orbe shoot Walton after he walked over to the SUV after Walton smashed into him.

Orbe allegedly claimed Walton was robbing her but police didn’t find any of her items in his possession. Her public defender indicated Walton had been arrested for assault in September and had a “predisposition for violence.”

Orbe is currently five weeks pregnant and the mother of four children.

A judge set Orbe’s bail at $100,000.
