College frat suspended for second time after more members are accused of sexually assaulting young woman: Police

Two University of Central Florida students were arrested on Tuesday after a female college student reported she was raped while attending a frat party on Saturday night.

The Orlando Sentinel reports that David Anthony Kirk (pictured left), 20, and Jack Ryan Smith (pictured right), 26, are accused of sexual battery after a woman who attended a Alpha Tau Omega fraternity party off of the 4900 block of Fiske Circle called authorities and told them the suspects sexually assaulted her. The incident happened after a night of drinking, the victim reportedly told police.

According to police reports, the victim stated she drank alcohol on the way to the party, then continued to drink once she arrived. She spent the majority of the night in the backyard of the home by a fire pit with Kirk and Smith. At some point she lost memory of the night until she woke up naked in a bedroom with her stomach across a bed and her feet on the floor. The victim said Smith was raping her while Kirk attempted to force his penis into her mouth.

The victim also reportedly said that the men exchanged words about switching places, saying, “my turn, my turn.” She said she lost consciousness again but later woke up in a bathroom. She sent text messages to friends for help, who picked her up and brought her home. The following day she went to Florida Hospital East Orlando.

Kirk was arrested on Tuesday while Smith was arrested on Saturday. Both are facing sexual battery charges.

This isn’t the first time members of the Alpha Tau Omega have been accused of rape. Another woman previously reported being raped after a “New Years in July” party the fraternity reportedly held. Police arrested Alexander Garces, 22, and Antonio Candido, 22, in August and charged with sexual battery and false imprisonment. The charges were later dropped.

This is the second time in less than a year that the fraternity faces temporary suspension while the incident is investigated.
