Texas Judge Grants $100 Bond to 21-Year-Old Arrested for Assault While Impeding Another’s Breath

Prior to his suspension last year, 228th District Judge Frank Aguilar granted “some of the lowest bonds” to felony offenders.

According to Andy Kahan with Houston Crime Stoppers, 21-year-old Frank Njoroge, who was convicted of assault while impeding breath in 2023, was given deferred probation by Aguilar. Then, two months into his probation sentence, he allegedly attacked someone and violated a protection order.

Aguilar also reportedly set $100 bonds for numerous other defendants, including those accused of serious offenses such as sexual assault and domestic violence. And seven times, according to Fox 26, the judge set Njoroge’s bond at $100.

“How on earth do you justify giving $100 bonds for a slew of violent offenses, including sex assault and kidnapping, while you are on probation for multiple domestic violence charges? It simply defies logic,” Kahan told CrimeOnline.

Court documents indicate that Njoroge repeatedly attacked a woman, telling her at least once, “It’s your death wish day.”

“Choked her on a few occasions till she couldn’t breathe. Bit her on quite a few occasions,” a family member told Fox 26. “Bit her toenail off at one point.”

Although the Harris County DA pushed to send Njoroge to prison, Aguilar reportedly rejected the motion and instead, allowed him out of jail. Then, in January, Aguilar was arrested himself for assault.

“You shouldn’t be hearing cases involving domestic violence when you yourself are facing a charge involving domestic violence,” Kahan added.
