A cell phone video reportedly shows a 17-year-old waving around a rifle minutes before it fires, fatally shooting his 15-year-old girlfriend.
Javon Martin was charged with criminally negligent homicide for Sunday’s shooting that left Makaila Simon dead. Authorities told KSAT that Martin wounded Simon in her chest at a home in Spring; Simon’s mother claimed her daughter was recording with her cell phone in the minutes leading up to the fatal shooting.
During the 7-second video, Simon was apparently heard laughing and telling Martin to “stop” as he points a rifle in her direction with his finger on the trigger.
Simon reportedly died at the scene. Police are working to determine whether Martin intentionally shot and killed his girlfriend, according to The Dallas Morning News. However, Simon’s mother told KPRC that she doesn’t believe the shooting was accidental.
“We don’t know if it was accidental in terms of just playing [with] the weapon and the gun went off or if there was other intent,” Houston, Harris County Sheriff Ed Gonzalez said.
Court records obtained by the news outlet revealed Martin was indicted on an unauthorized use of a vehicle charge in July and was scheduled to stand trial this June.
The victim’s mother said, “Something needs to be done as far as gun violence. It should be no reason why a 15-year-old or 14-year-old have guns. It should be no reason how parents are even allowing guns to even be in their home.”
