Jury Awards $800,000 to Family of Girl Burned by McDonald’s Chicken McNugget

A jury on Wednesday awarded a Florida family $800,000 in a lawsuit alleging a McDonald’s chicken nugget severely burned a 4-year-old girl in 2019.

Back in May, the jury reached a split verdict in the suit brought by Philana Holmes and Humberto Caraballo Estevez, parents of now-8-year-old Olivia Caraballo, saying the girl suffered second-degree burns when an “unreasonably and dangerously” hot McNugget got stuck in her car seat and burned her leg, WTVJ reported.

The jury found that while McDonald’s and the franchise owner, Upchurch Foods, had failed to put warnings on the food leading to Olivia’s injury, McDonald’s was found not negligent in causing the burns.

Neither McDonald’s nor Upchurch were happy with the verdict, but the family said it was pleased with the decision and hoped that it would lead to change.

The family asked for $15 million in the damages portion of the lawsuit trial, but their attorneys said jury’s decision was “fair and just.”

“This momentous decision brings meaningful closure to an arduous and protracted legal process,” the attorneys said in a statement. “Having previously established the defendants, Upchurch Foods Inc and McDonald’s USA LLC, as liable for their wrongful actions, this verdict reaffirms that they must now face the consequences and provide full justice. Despite years of denying any fault and, during this trial, attempting to undermine the extent of Olivia’s suffering in the eyes of the community, their efforts have been superseded by the jury’s determination.”

The company and the franchise owner did not respond immediately to requests for comment.
