‘Cult Mom’ Lori Vallow Daybell Files Notice of Appeal

Lori Vallow Daybell, convicted of murder and conspiracy to murder in the deaths of two of her children and her fifth husband’s first wife, filed notice last week to appeal the verdict and sentence.

Jim Archibald, attorney for the so-called “cult mom,” filed the notice on Thursday, citing 16 issues in the trial and indicating there could be more by the time the appeal goes before a judge.

Among the issues Archibald listed are questions surrounding decisions about her competency, whether her right to a speedy trial were violated by the court’s decisions, several questions regarding the technical details of the conspiracy charges and alleged conspirators, and whether the sentencing court properly reviewed evidence and if it abused its discretion in handing down the three life sentences without parole.

Archibald also asked for a number of transcripts from the trial, including some that were sealed.

Vallow Daybell and her husband, Chad Daybell, were charged in the deaths of 16-year-old Tylee Ryan and 7-year-old JJ Vallow after a months-long search for the children that ended when they were found dead and buried on Daybell’s property. During the search, the Daybells at first said the children were with relatives and then fled to Hawaii before Vallow Daybell was arrested and brought back to Idaho. Daybell was arrested when the children’s bodies were found.

The search also drew more scrutiny to the death so Daybell’s wife and Vallow Daybell’s previous husband, Charles Vallow, who was shot to death by Vallow Daybell’s brother, Alex Cox, a few weeks before Tammy Daybell’s death and the marriage of Chad and Lori Daybell. Cox claimed self-defense and then died, reportedly of natural causes, a few months later.

Idaho investigators added the death of Tammy Daybell to the charges against the couple, while Arizona investigators charged Vallow Daybell with conspiracy in Charles Vallow’s death.

Vallow Daybell reportedly told friends that Charles Vallow, Tylee Ryan, JJ Vallow, and Tammy Daybell were all “zombies” who needed to die. She was convicted in May in the deaths of the children and Tammy Daybell.

Daybell is awaiting trial on the same charges after successfully arguing to have his case severed from his wife’s and waiving his right to a speedy trial. Arizona has begun the extradition process to bring Vallow Daybell back to that state for the conspiracy trial.
