San Jose Daycare Owners Arrested After 2 Toddlers Drown in Pool

California police have arrested the mother and daughter co-owners of a home-based daycare where two toddlers drowned in a pool earlier this month.

Nina Fathizadeh, 31, and her mother Shahin Gheblehshenas, 64, surrendered to San Jose Police on Friday, KGO reported. They have been charged with felony child endangerment and are scheduled for arraignment on December. 6.

The Santa Clara District Attorney’s Office said that Gheblehshenas left the house that morning, on October 2, leaving four children under her daughter’s care. Fathizadeh was making breakfast with one child in a crib. She let the other three into the rear play area, unsupervised and out of her sight.

Five minutes later, Fathizadeh discovered one of the children floating in the pool and began CPR. Her brother found the other two children, unconscious in the pool’s deep end.

All three children were taken to a hospital, where Payton Cobb and Lilian Hanan were pronounced dead. The third child was in critical condition but is expected to make a full recovery.

Investigators say a pool gate was left propped open while someone was watering plants. Neither of the owners checked the gate before letting the children into the back.

As CrimeOnline previously reported, the Happy Happy Daycare was licensed in January 2021, and the Department of Social Services said it had visited eight times since then, including once to discuss the pool. The owners had to adjust the pool fence as a result of that visit.

The daycare was cited for three violations in January 2023, but inspectors found no violations in June. The last visit was a surprise inspection earlier this month in which the inspector cited the owners for not documenting safe sleep checks every 15 minutes.
